In Malaysia, the question arises is gambling taxable in Malaysia? I will discuss why sports betting is not taxable in Malaysia. Sports gambling is not taxable in Malaysia as in other countries. The law is time consuming and not applicable everywhere.

Gambling in Malaysia is subject to regulation based on the territory of Malaysia i.e. Federal capital region and others. In accordance with Federal law, gambling is only permissible in accordance with the following authority: the Attorney General, the Registry of Income and Gifts, and the Tan Sri Hari Berhad (the Secretary to the High Commission for Sports). The regulation is very complicated and not applicable in all the areas. The gambling industry is still very strong support of the government, most especially the ruling Malaysian People’s Party has been instrumental in protecting the interests of the gambling industry in keeping the legality of gambling in Malaysia intact.

Malaysia is home to many high profile sports clubs and games including soccer, tennis, horse racing, and ice skating. Some of these games are only held legally in hotels and casinos. As a result of the same reasons, there are problems associated with the authorities and some gaming companies have resorted to methods of laundering the proceeds from the gambling activities by using their own casinos and sports clubs.

Recently, the Federal Treasury Department has issued a notice to the National Lottery Commission (NLC) and the Malaysian Casino Commission (MCC) that they must cease and desist from operating any games and sporting events which is gambling under the law of Malaysia. The notice was released after a meeting between the Attorney General and the Secretary for Public Development, who is responsible for the anti-gambling activities in Malaysia. According to the Attorney General, both the bodies have failed to protect the interest of the people from the effects of gambling and had failed to implement laws that have been formulated by the legislature in keeping with international standards. According to him, both bodies have also failed to respond adequately to the demands made by the Malaysian public from the impact of online gambling on the society and to the impact of sado-masno-pagina (shoot the man, beating up the woman).

In line with this development, the Attorney General has written a letter to Prime Minister Raji Setai so as to request him to take immediate action on the matter. He has further stated that the Malaysian government is committed to eradicate gambling activities in Malaysia by all legal means available. In his letter, he has requested the prime minister to instruct the Secretaries of the Houses of the assembly, the chief executive and other members of cabinet to immediately stop the operations of all gambling facilities within their jurisdiction. He has asked the prime minister to ensure that police authorities are able to carry out their duties in carrying out investigations in line with their responsibilities as provided by the Prevention of Human Rights abuses Act.

On Friday, the head of the Malaysian National Anti-Gambling Commission (MADD) publicly called for the closing down of all gambling facilities within the country, including the ones owned by the three Malaysian gambling companies mentioned above. Mr. Wan Jan Lim, the Executive Secretary of MADD, stated that all the existing gambling facilities should be closed down because they are part of the problem. He further called for the immediate suspension of operations of all gambling companies until the problems in gambling are solved. He further called on the government to immediately form a task force to look into the problem of gambling, which is currently one of the major problems in Malaysia.

The Malaysian Sports Council has also joined hands with the Sports Development Institute of Malaysia (SDIM) in implementing its campaign to eradicate sports betting in Malaysia. Earlier this month, the National Assembly took a resolution against sports betting ban in Malaysia stating that it will be detrimental to the developing sports sector in Malaysia. The resolution was however, later changed when the House of Representatives and the Senate voted in favour of the proposition. The House of Representatives was led by former Attorney General, who is now the Prime Minister; while the Senate was dominated by the majority of Malaysia’s Barangay assembly.

The chief executive of SDIM, Mr. Terence Soh, has also publicly stated that he has discussed the matter with the prime minister and asked for the implementation of a ban on gambling in Malaysia. However, he has yet to get a response from the prime minister on the same. A number of local gambling operators have also come up with their own plans to introduce a gambling casino in Malaysia. Among these is the one proposed by the New Generation International which is to be based at the Cheryuan resort in Putrajong, Malaysia. The said casino is also supposed to be connected to the World Trade Center, Kuala Lumpur.
